एनआरएन अमेरिकाको बोर्डको अगस्ट १ तारिख बेलुकी बसेको बैठकमा ९ सदस्यीय कार्य समिती सदस्यहरु मध्ये ६ जनाको बहुमतले प्रेसिडेन्ट प्रल्हाद केसीलाई एकलौटी ढंगले अप्रजातान्त्रिक तवरले निर्णयहरु गरेको भन्दै प्रेसिडेन्ट पदबाट बर्खास्त गरेको थियो। (हेर्नुहोस्) त्यसको प्रतिकारमा प्रेसिडेन्ट केसीले संघको बिधनत: आफू अध्यक्ष रहिरहेको दावी (हेर्नुहोस्) गरेपछि बैधानिकताको घम्साघम्सी उब्जेको थियो। तर आफ्नो प्रेसिडेन्ट पदमा रहिरहेको भन्ने दावीलाई त्याग गरेर अगस्ट ४ तारिख प्रेसिडेन्ट केसीले अमेरिकाबाट संघको आईसिसीमा प्रतिनिधित्व गर्ने ७ जना सदस्यहरुलाई साथलिएर सामूहिक राजिनामा दिएपछि को आधिकारिक र बैधानिक भन्ने बिबादले नयाँ मोड लिएको छ।

क-कस्ले राजिनामा दिए?

यसरी सामूहिक राजिनामा दिनेहरुमा एनआरएन अमेरिका प्रसिडेन्ट प्रल्हाद केसी, आईसिसी उत्तर अमेरिकि क्षेत्रिय संयोजक मुकेश सिंह, उपसंयोजक रामचन्द्र खरेल, आईसिसी सल्लाहकार डा. अम्बिका अधिकारी, आईसिसी सदस्य सोनाम लामा, सिआईसि संयोजक अन्जन श्रेष्ठ, उपसंयोजक डा. शम्भु ढुङ्गाना र आईसिसी च्यारिटी टास्क फोर्स सदस्य रमाकान्त खरेल छन्।

RE: NRN NCC of USA  Mass Resignation

Dear Jiba jee and fellow NRN's:

I would like to make it very clear that since I have taken the position of President of NRN-NCC of USA, all my official duties has been discharged in accordance of the by-laws of NRN-NCC of USA. With respect to my recent decisions to conduct the election of full board was done in accordance with the by-laws. The NRNA global president and other ICC officials have requested me to facilitate and conduct the election prior to the global conference which is expected to take place in the month of October. NRN-NCC of USA is an affiliated organization of NRNA and I wanted to make sure that our NRN-NCC respects the will of NRNA ICC.

To that end, I have discussed with then election commissioner if he was willing to conduct the election and he indicated that he will rather step aside. Honoring his will, I relieved him from his duties to pave the way for the election. Subsequently, I formed an election commission to conduct the election.

My decisions were not liked by several board members and they made a decision to remove me without following the removal process stated in the by-laws of NRN-NCC of USA. Via media and through the legal notice served to me today, I became aware of such decision.

Fellow NRN’s, please understand that I volunteer my time to advance the causes of NRN and accepted the position of president. I believe in this organization. Therefore, I do not want to create a parallel governance structure. In order to clear the way for the remaining executive board to function in an efficient manner, I am voluntarily resigning from my position of president.

I wish NRN-NCC of USA the best. I will be happy to work with the current committee to facilitate a smooth transition. I would like to thank all of you for giving me an opportunity to serve as your president.

के कुराले राजिनामा गर्न वाध्य पार्‍यो?

अगस्ट ३ तारिख बिहान बिशेष भिडियो अन्तर्वाताकालागि न्यू योर्कबाट अमेरिकाको मासाचुसेट्स राज्यको बोस्टन शहरको बेड्फोर्डस्थित एनआरएन अमेरिका प्रेसिडेन्ट प्रल्हाद केसीको निवास पुगेको युएस नेपाल अनलाइनको यो पङ्क्तिकारलाई प्रेसिडेन्ट केसीले आफू प्रेसिडेन्ट रहिरहेको र आफूलाई बर्खास्त गर्ने बोर्ड सदस्यहरुसंग वार्ता गर्न र को बैधानिक भन्ने समस्यालाई "सेफ ल्यान्डिङ" गर्न र अक्टोबर १९-२१ बिच काठमाडौंमा हुन लागेको छैठौं एनआरएन विश्व सम्मेलन अघि एनआरएन अमेरिकाको निर्वाचन गराउन आफू कटिबद्ध रहेको बताएका थिए।

तर सोही दिन अपरान्ह बरिस्ठ उपाध्यक्षबाट कार्यबाहक प्रेसिडेन्ट बनेका शिवकुमार राईको बोर्डले नियुक्त गरेको वकिल डिपो अकिन्-डेकोको कानुनी सेवा कम्पनीले अपदस्त प्रेसिडेन्ट केसीलाई कानूनी उपचारकोलागि सात दिने म्यादको पत्र काटेपछि सामूहिक राजिनामा आएको थियो।

स्मरण रहोस्, यो त्यही कानुनी सेवा कम्पनी हो जसले यस अघि अर्को अमेरिकि नेपाली संस्था एएनए (ANA) को २८ औं बोस्टन सम्मेलनपछि उब्जेको कानूनी झमेलालाई टुङ्गोमा पुर्‍याउन र बर्सौंसम्म दर्ता खारेज भएको एएनएलाई पुनर्स्थापन गर्न सफल भएको थियो।

Dear Prahlad KC

Please be advised that Akin-Deko Professional Services Firm PLLC has been retained by NRN NCC of USA (Hereafter “NRN”) concerning your improper and unlawful board actions. The purposes of this letter is to settle this matter in a way that is most beneficial to NRN NCC of USA. It is written without prejudice to my client.

It has come to our attention that under your Presidency you intentionally usurped the authority of the Executive Board (Hereafter “Board”) of NRN NCC of USA and engaged in decision making and activities that were not sanctioned and were in clear violation of NRN by laws and code of conduct. These activities include but are not limited to the following:

-Attempting to hold an unsanctioned election that is in clear violation of the by-laws (Article XIV)

-Illegally disbanding the election committee without authority of the Board(Article VIII and Article XIV)

-Refusing to participate in board meetings as held by the Board (Article VIII)

-Refusing to adhere to the democratic process and Roberts Rules of Order as set forth by the By-Laws (Article XXII)

-Breaching your fiduciary duty and duty of loyalty to NRN (Article XXIII)

-Using NRN financial resources without Board approval (Article XXIII)

-Using NRN financial resources against Board decision (Article XXIII)

-Engaging in Self-Dealing (Article XXIII)

Additional and separate from the direct harm you have caused to NRN and fraudulently misrepresented your address and standing as “Principal” to the secretary of state of Tennessee where NRN is registered. Your actions are in clear violation of your duty as President.

Article 5, Section 2 of the By-Laws states that:

“The Board shall have power and discretion to issue procedure for filing an application for a membership. The application for membership shall be reviewed and approved, at its discretion, by Regional Chapter or Board. The membership can be revoked by Board if the Board determines that a member has violated or acted against the objectives or by-laws of the Council.”

Your actions have been determined to be an abuse of your position as President and in clear violation of NRN’s Code of Conduct as well as the by-laws. Therefore, as of August 1, 2013, by Board action and decree you have been relieved of your Presidential duties and removed from your position on the Board of NRN. Pursuant to Article VIII, Paragraph 14, “The Senior Vice President shall act as President in the event of the President's death, resignation, removal or temporary absence and shall have all the powers and duties of the President.

Any actions that you have taken including but not limited the dissolution of the election committee, the appointing of a new election committee, the authorizing of funds for a board election are hereby null and void. Only actions that have been voted and approved by the Board under the rules set forth under the by-laws will be considered valid. NRN requires you inform our office of any activities you have engaged upon without Board approval including any agreements or contracts you have entered into without board knowledge.

You are required to turn over and assign any accounts (bank, web, credit, etc), records, or property that were tendered to you as part of your position as President within seven days of this letter. If you fail to tender all accounts, records or property after seven days have passed OR you continue holding yourself out as the President of NRN after Board removal, our office and affiliates will file a legal action in the form of an injunction and legal/monetary damages in a court of competent jurisdiction against you and any individual or parties (whether located in the United States or abroad) who attempt to carry on NRN business by your order and against that of the Board.
