Voice for Nepalese Indigenous Peoples Rights UN Indigenous Peoples Declaration and ILO Convention 169 Should be Guaranteed in the New Constitution ![]() Guests at the NFDIN programme. Photos: Sangmo Kathmandu, August 8, 2008- Indigenous rights activists in Nepal stressed on the need to incorporate United Nation Declaration on the Rights of Indigenous Peoples (UNDRIP) and International Labor Organization (ILO) Convention 169 in a new constitution of Nepal as a fundamental rights to secure the rights of Indigenous Nationalities. They demanded right to self determination and cultural autonomy to be ensured in a new constitution in order to emancipate from a decade long oppression made by non Indigenous groups in the past. In an interaction program organized by National Foundation for the Development of Indigenous Nationalities (NFDIN) on the occasion of World's Indigenous Day 2008 on Thursday in capital, they demanded an effective implementation of UNDRIP and ILO Convention 169 to ascertain the rights of Indigenous Peoples (IPs) for their culture, language, natural resources and right to self determination. Presenting the paper on "United Nation Declaration on the rights of Indigenous Peoples in the context of Nepal" Sociologist as well as Indigenous leader Dr. Krishna Bhattachan stated that right to self determination and cultural autonomy should be guaranteed as fundamental rights of IPs in a new constitution. "Like Bolivia which has converted the ILO convention 169 into country's law, Nepal should also incorporate it in the new constitution." said Dr. Bhattachan. He pointed out the need to organize awareness campaigns and trainings at government offices, committees of political parties, media houses and human right organizations for the effective implementation of the UN Declaration. |

He further stated that a dialogue between government, international government organizations, donor agencies, private sector and IPs should be hold by the cultural organizations. ![]() Sociologist Dr. Krishna Bhattachan. "It is also necessary to monitor UNDRIP and ILO Convention 169 regularly for its effective implementation." Dr. Battachan said stating that no articles concerning the IPs can be written in new constitution without their consent. "The IPs should be informed before the National Planning Commission and Council of Ministers makes decision that affects them." Commenting on the paper Ashokkumar Rai said the Declaration is a guideline for the Constitution Assembly (CA)." It has ensured the rights of IPs and state's responsibility." he further said, "The IPs demand for Right to self determination is not to suppress other groups rather its an aspiration of IPs to get emancipation from oppression." Another commentator CPN-Maoist leader and CA member Pampha Bushal said the right to self determination should be given to IPs. She expressed a strong commitment to raise the issues of right to determination, cultural autonomy in CA and to implement UNDRIP in a new constituion. NFDIN member secretary Lok Bahadur Thapa Magar said Indigenous Nationalities and other non Indigenous groups should walk together to ensure their rights in the constitution."
