Call to Ensure Indigenous Rights in the New Constitution

Kathmandu, August 11, 2008- Indigenous Peoples rights activities underscored the need to implement the International Labor Organization (ILO) Convention 169 in the new constitution to secure the rights of Indigenous Nationalities.

Presenting a paper on " How can Indigenous Nationalities ensure their rights in Constituent Assembly from local level " at an interaction and cultural program organized by National Indigenous Women Network (NIWN) on Monday in the capital, Sociologist as well as Indigenous leader Dr. Krishna Bhattachan urged Constitution Assembly (CA) lawmakers affiliated to Indigenous groups to play pro-active role in drafting constitution by enlisting the rights guaranteed by the ILO Convention 169 and UN Declaration.

"The pressure should be given to political parties and CA members to include the provisions of ILO Convention 169 and UN Declaration in the new constitution and later in law, policy, plan and programmes." said Dr. Bhattachan.

He threatened to revolt if the constitution failed to fulfill Indigenous Peoples' demand for Right to Self Determination with Cultural Autonomy stating, "The state and CA would be solely responsible for that situation."

He said no article concerning Indigenous People should be inserted in the new constitution without prior consent of Indigenous Nationalities.

Chairperson of Federal Democratic National Forum D.K Buddhist claimed that the guarantee for right to cultural autonomy and self determination would be impossible without the implementation of ILO Convention.

Indigenous Women Activist Yosakanta Bhattachan demanded recognization of Indigenous Women's identity and the guarantee of their rights in the new constitution.

General Secretary of UML, Jhalanath Khanal who chaired the function said CA members should follow the peoples mandate by ensuring their rights in a constitution in an effective manner.

"It is essential to create a pressure on CA lawmakers to address the demands of Indigenous as well as non Indigenous Peoples and to perform their task smoothly so as to make inclusive constitution." Khanal said.

He also informed that the new government will be form soon.

Meanwhile, at the function, cultural fashion show was held where 9 ethnic groups of Nepal that include Tamang, Gurung, Sherpa, Newar, Danuwar, Thami, Majhi, Bhujel and Jirel displayed their cultural attire along with their traditional ornaments.

A 45 minutes long documentary based on Indigenous Peoples' ritual, culture, tradition was also screened at the function.
