Urgent Need to Implement ‘International Convention on Elimination of Racial Discrimination,1965’ When will end Racial Discrimination in Nepal? -Sangmo Yonjan-Tamang in Kathmandu, Nepal काठमाडौं, March 25, 2008-Many believe that elimination of racial discrimination based on religion is impossible without guaranteed equal representation for all, including the underprivileged groups, in the Constitution Assembly (CA) Poll and access to every sector of the state. ![]() Guests attending at an interaction programme. The country must implement provisions of International Convention on Elimination of Racial Discrimination (ICERD), 1965, by the state in order to ban all forms of discrimination including linguistic, religious, gender, racial, caste, gender, and geographical. Speaking at a programme on March 24, 2008 in Lalitpur, organized by National Coalition Against Racial Discrimination (N-CARD), Fatima Foundation, Namuna Nepal, Lawyer Association on Human Right Nepalese Indigenous People (LAHURNIP), NEFIN, NIWF, DNF, FFP and FEDO to mark the 43th International Racial Discrimination Elimination Day (March 21), the representatives of the different organizations demanded participation by underprivileged groups at the decision and policy making level for effective implementation of national and international laws. Parliamentarian and indigenous expert Malla K. Sundar said the declaration of the end of the feudal and unitary state structure, and elimination of racial discrimination ought to be a guiding principle in the CA poll. “Discrimination against Janajatis, minority groups, and nomadic peoples can also be considered racial discrimination” he stated, adding that “while the country is in the process of political as well as social transformation it is necessary to broadly define the issues of racial discrimination to eliminate it from the country”. At the same event, Advocate Sambojan Limbu presented a paper titled “International Convention on Elimination of Racial Discrimination (ICERD), its Implementation and Role of Effectiveness”. He expressed concern regarding the report prepared by the state and submitted to UN saying “The report is not satisfactory, it is totally biased in that it included only the national plan, policies and declaration on racial discrimination but doesn’t talk about its implementation and existing practices in Nepal.” He noted that the report lacked a definition of the term ‘Racial Discrimination’ in a broader sense, but understood it merely as discrimination against the untouchable group. “The state didn’t consult with civil society and human rights commission while preparing the report.” he complained. Chairman of the National Dalit Commission, Ram Lal Bishwokarma said “Racial Discrimination is not only the problem of the Dalit but is also a class problem. In the present context, everyone is focused on conducting CA Polls in a free and fair manner, so only after restructuring of the state can we make interruption on the racial discrimination issues at national and international levels…reviewing issues related to racial discrimination is important for the elimination of discrimination in the present context.” ![]() Member of National Human Right Commission(NHRC) R.B Rokaya. Rokaya, member of the National Human Rights Commission expressed the view that federal state structure would only put an end to the existing different kinds of discrimination in the society. “Discrimination based on religion is the most difficult one to solve, but an effort is necessary for the elimination of every form of discrimination.” Vice-chairperson of the National Foundation for Development of Indigenous Nationalities (NFDIN), Mr Jit Pal Kirat claimed the restructuring of the state in the federal system based on cultural autonomy is the only solution for the elimination of racial discrimination. “Due to the state’s control of resources, the issues of discrimination have become extreme.” he added. National Womens’ Commission President, Naina Kala Thapa, Dr. Sumitra Manandhar-Gurung and other participants expressed their views that the state should be more responsible and accountable to ensure the right of disadvantaged and underprivileged groups. They urged the state, political parties, civil society and national as well as international organizations to help in the effective implementation of provision of ICERD. |
