Model Constitution for New Nepal

Kathmandu, August 1, 2008 A Model for the new Constitution for Federal Democratic Republic of Nepal, prepared by the National Coalition against Racial Discrimination (N-CARD) was made public in the capital on Thursday amidst Constituent Assembly Members.

Constituent Assembly (CA) Chairperson Subhas Chandra Nembang unveiled the 152 page Model of Constitution that consists of 345 Articles and 12 Appendices.

In this model constitution, Nepal is divided into 12 autonomous states, namely Limbuwan, Khambuwan, Tamangsaling, Nepalmandal, Tamuwan, Magarat, Purbakhasang (Karnali Pradesh), Paschim Khasang, Tharuhut, Aawadhi, Bhojpuri and Maithali Madhesi, autonomous states based on ethnicity and languages.

Speaking at the function, CA chairperson Subhas Chandra Nembang said many things that are written in this model constitution have to be followed while drafting a new constitution. "As this constitution is written by those marginalized and minorities groups whose representation is not in CA, it would really help to meet their aspirations and demands in CA" he added.

He suggested that all the CA members draft the new constitution in the stipulated time maintaining solidarity among each other, "The constitution making process has becoming delayed and it’s high time to draft a new constitution promptly in order to make an inclusive new Nepal" Nembang stated.

He stressed the need to develop consensus and understanding among political parties to form a new government.

Soon after the Model Constitution was made public, Himali representatives tore out the model constitution stating that 'Himali Autonomous State' has not been declared in the model of new constitution.

They have been demanding a separate Himali Autonomous State to ensure the rights of all Himali Indigenous Nationalities of the mountainous regions.

Talking to the press, Aang Kaji Sherpa, General Secretary of Himali Loktantric Ganatantrik Nagarik Manch (Himali Democratic Republic Civil Forum) expressed his great dissatisfaction for not including their views and concepts in it". “This constitution discriminated against Himali people by not including our views and the demands of Himali Autonomous State" said Sherpa adding "If federalism is created based on nationality, Himali people too have a right to get it."

Dr. Sumitra Manadhar Gurung, Chairperson of N-CARD, said this constitution is a reference for present CA. "The things that are written in this constitution are not the authorized views of N-CARD. It’s a common concept of peoples of different caste, ethnicity, culture, religion and region represented in Model Constitution making process."

Human rights activist Padma Ratna Tuladhar, Indigenous leader Mall K. Sundar and Bal Krishna Mabuhang and others also expressed their views about the model constitution.

This Model Constitution was made during the meeting organized by N-CARD from May 10 to 23, 2008 at Kharipati, Bhaktapur with the participation of 96 model CA members that included Women, Dalit, Janajaties, Madhesi, Muslims, Marginalized groups, Endangered Ethnic Group, Minorities and other groups.
